CHENNAI: The Madras HC has held that service tax is not going to be relevant on takeaway orders in restaurants and hotels.
Justice Anita Sumanth handed the order whereas permitting a batch of pleas moved by in style restaurant chains, together with Anjappar, Thalappakatti and Sangeetha Accommodations, difficult the notices issued by the commissioner of GST and central excise demanding service tax for takeaway orders.
The bench held that such provision of food and drinks taken away from eating places tantamount to “solely sale and never consumption” on the restaurant attracting service tax.
